1. About These Terms
These Terms of Service ("Terms") govern your use of The Blood Type Diet® mobile application for Android and iOS (the "App"). The App is provided by North American Pharmacal, Inc. ("we," "us," or "our"), 149 Water St, Norwalk, Connecticut, USA, 06854.
By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

2. License and Acceptable Use
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, for your own non-commercial use, in accordance with these Terms and the terms of the app store you downloaded it from.
You agree not to:
- copy, modify, distribute, sell, or sublicense the App or its content;
- reverse engineer or attempt to extract the App's source code, except where applicable law permits;
- use the App for any unlawful purpose or in a way that could damage, disable, or impair it;
- circumvent any security, access, or purchase controls in the App.
3. Purchases and Refunds
All payments are processed by Google Play or the Apple App Store, not by us, and are subject to that store's terms, billing, and refund policies.
Refund requests are handled by the store you purchased from. Nothing in these Terms limits any refund, withdrawal, or other rights you have under consumer protection laws that apply to you.
4. Health Information Disclaimer
The App provides general educational and informational content about diet and nutrition based on the work of Dr. Peter J. D'Adamo. It is not medical advice and is not intended to diagnose, treat, cure, or prevent any disease.
Always consult a physician or other qualified healthcare provider before changing your diet, starting a supplement, or if you are pregnant, nursing, taking medication, or have a medical condition. Never disregard professional medical advice or delay seeking it because of something in the App.
Statements about dietary supplements have not been evaluated by the Food and Drug Administration. Individual results vary.
5. Intellectual Property
The App and its content, including text, recipes, food lists, graphics, and software, are owned by us or our licensors and are protected by copyright, trademark, and other laws. The Blood Type Diet® and related names and logos are trademarks of their respective owners. These Terms do not grant you any rights to our trademarks.
6. Privacy
Our collection and use of information through the App is described in our Privacy Policy at https://www.4yourtype.com/privacy-policy/.
7. Disclaimers
To the fullest extent permitted by law, the App is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that its content is complete or current.
8. Limitation of Liability
To the fullest extent permitted by law, North American Pharmacal, Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability for any claim relating to the App will not exceed the amount you paid for the App or in-app purchases in the 12 months before the claim.
Some jurisdictions do not allow these exclusions or limits, so they may not apply to you. Nothing in these Terms excludes liability that cannot be excluded by law, or limits mandatory rights you have as a consumer in your country of residence, including in the European Economic Area and the United Kingdom.
9. Termination
You may stop using the App at any time by deleting it. We may suspend or end your access if you breach these Terms. Sections that by their nature should survive termination will survive.
10. Changes to the App and These Terms
We may update the App or these Terms from time to time. When we change these Terms, we will post the updated version at this URL and update the effective date. Continued use of the App after changes take effect means you accept the updated Terms.
11. Governing Law
These Terms are governed by the laws of the State of Connecticut, USA, without regard to conflict-of-law rules. If you are a consumer residing outside the United States, you also keep the protection of mandatory laws of your country of residence and may bring claims in its courts where those laws allow.
12. App Store Terms
If you downloaded the App from the Apple App Store or Google Play, your use is also subject to that store's terms. Apple and Google are not parties to these Terms and are not responsible for the App or its content.
